Contract Scope
All work performed by CDM and Associates Worldwide LLC, its assigns, or subcontractors is limited strictly to the scope described on the delivery ticket, service order, invoice, or written agreement. No additional work is included unless expressly stated in writing.
Materials are classified as unscreened fill material unless otherwise stated and may contain construction debris, rocks, organic matter, or soil variations. CDM and Associates Worldwide LLC requires clear, safe, and unrestricted access to all loading, delivery, or service locations.
Damage and Site Conditions
Any damage occurring within the curb line, driveway, service area, or job site is the responsibility of the Customer. CDM and Associates Worldwide LLC, its assigns, and subcontractors are not responsible for rubber tire marks, surface scarring, cosmetic damage, turf damage, or incidental settlement to soil, pavement, or structures.
The Customer is responsible for identifying hazards including but not limited to utilities, curbs, drainage structures, landscaping, pavement edges, concrete features, septic systems, irrigation lines, and underground conditions.
Delivery and Cancellation
Cancellations must be received no fewer than three business days prior to the scheduled delivery or service date. Failure to provide timely cancellation may result in full charges for materials, mobilization, delivery, or service.
If Customer personnel are not present to accept delivery or service as scheduled, and a cancellation notice was not properly received, the Customer remains responsible for the full charge. CDM shall not be liable for delays or failure to perform caused by weather, acts of God, equipment availability, supplier delays, governmental action, or conditions beyond its control.
Warranty Disclaimer
There are no warranties, expressed or implied, including warranties of merchantability or fitness for a particular purpose. Acceptance of materials or services releases CDM and Associates Worldwide LLC, its assigns, and subcontractors from liability related to delivery, placement, or use.
Authority and Access
The signatory represents that they have legal authority to authorize entry onto the property. The Customer authorizes CDM and Associates Worldwide LLC, its assigns, and subcontractors to enter private property to perform delivery or service and agrees to hold harmless and indemnify CDM and Associates Worldwide LLC from any claims, damages, or losses arising from such entry.
Emergency Snow Removal Services
Emergency snow removal services are performed using heavy equipment, including Bobcat loader machinery. Snow removal services are intended to improve access and mobility only and do not guarantee bare pavement, ice-free conditions, or complete snow removal.
A 250.00 mobilization fee applies once equipment is dispatched and is non-refundable after dispatch. Hourly service charges begin upon arrival on site and continue until equipment leaves the property.
Snow and ice conditions may conceal curbs, drainage structures, utility covers, landscaping, pavement defects, concrete edges, asphalt seams, or other fixed or hidden objects. The Customer acknowledges these risks and accepts full responsibility for site conditions.
The Customer authorizes CDM and Associates Worldwide LLC, its assigns, and subcontractors to perform snow removal services and agrees to hold harmless and indemnify CDM and Associates Worldwide LLC from any and all claims resulting from snow removal operations.
Service timing is dependent on weather conditions, access, and equipment availability. Specific service times are not guaranteed during emergency snow events. Standby time, delays, or inability to perform service due to blocked access, parked vehicles, obstructions, or unsafe conditions remain billable.
Emergency Snow Service Refund Policy
Emergency snow removal services are non-refundable once equipment has been dispatched or mobilization has occurred, regardless of weather conditions. Weather changes, melting, refreezing, or partial site improvement do not qualify for refunds or credits.
Payment and Acceptance
Payment in full is required prior to delivery or service. Tender of payment constitutes acceptance of these Terms and Conditions and certifies completion of contracted work.
Limitation of Liability
In no event shall the liability of CDM and Associates Worldwide LLC exceed the total amount paid under the applicable contract or service order. The Customer agrees that this limitation represents the sole and exclusive remedy.
Governing Law and Venue
This agreement shall be governed by the laws of the Commonwealth of Virginia. Any dispute shall be resolved exclusively in the courts located in Fairfax County, Virginia.
Entire Agreement
These Terms and Conditions supersede all prior agreements. No modification shall be valid unless made in writing. CDM and Associates Worldwide LLC reserves the right to decline or rescind service prior to dispatch without liability.
